Frameit Membership Agreement

Thank you for using the [Frameit] member value-added service. In order to use the [Frameit] member value-added service (referred to as: this service), you should read and abide by the "Frameit Member Service Agreement" (referred to as: this agreement). Please be sure to carefully read and fully understand the content of each clause, especially the corresponding clauses such as exemption or limitation of liability, as well as a separate agreement for opening or using a service, and choose to accept or not accept it. The exclusion or limitation of liability clause may be prompted to your attention in bold form.
Juvenile shall be accompanied by a legal guardian to review and perform this Agreement, and Juvenile's exercise and performance of its rights and obligations under this Agreement shall be deemed to have been approved by the legal guardian.
Scope of the agreement
1.1 Scope of the subject of application of the agreement
This agreement is an agreement between you and Guangzhou Jiahua Information Technology Co., Ltd. regarding your use of this value-added service.
1.2 Your agreement to this agreement is deemed to be your voluntary acceptance and compliance with all service specifications, including this agreement, and related agreements and management specifications involved in Frameit's provision of services, including but not limited to Frameit's service agreement, Privacy Policy, membership-related agreements, activity rules, usage rules, announcements, prompts, notices, etc. published and revised by Frameit from time to time.
Service content
2.1 Member value-added service means that after you pay a certain service fee in accordance with Frameit's designated method, you can enjoy the privileged service provided by Frameit, referred to as: this service.
2.2Frameit may launch different member value-added services according to different product and service types, adjust existing member value-added service types, member rights and interests, etc., and continuously launch new member value-added service types. The specific type and service content of member value-added services are subject to the service content announced on the relevant service page and actually provided, and will take effect according to law after the announcement. You can choose the corresponding service according to your needs.
2.3 Special instructions on advertising: In the process of using Frameit member services, you will be exposed to commercial advertisements or other types of commercial information placed in various ways. Frameit will provide "ad-free privileges" and "ad-free privileges". The scope only refers to the content with the "advertising" logo in Frameit, excluding third-party information and other content. Advertising privileges include automatically skipping advertisements for you, or manually turning off content recommendations; however, this right may still present you with different types of advertising services due to copyright restrictions or other restrictions, and does not exclude Frameit from serving advertisements in other ways or commercial information. You understand and accept this, and you do not pursue and exempt Frameit from relevant responsibilities, and Frameit promises to minimize the impact on your experience.
Membership fees and duration
3.1 Fee standard and payment
3.1.1 This service is a paid service provided by Frameit, and you must pay the corresponding fee in accordance with the charging standard of this service before using this service.
3.1.2 Frameit may modify and change the charging standards and methods of this service according to the overall planning of this service. The aforesaid modifications and changes will be displayed by Frameit on the corresponding service page. If you need to obtain and use this service, please first understand the charging standards and methods of this service at that time. Your activation and payment behavior are deemed to be that you are fully aware of the charging standards and methods of Frameit providing charging services.
3.1.3 You can activate this service through the existing methods designated by Frameit, including but not limited to WeChat Pay, Alipay, Apple Pay, etc., and the methods designated by Frameit in the future after paying the fee according to the contract.
3.1.4 Frameit hereby declares that Frameit will not accept any form of refund request after you pay, unless you are repeatedly deducted when purchasing due to technical reasons of Frameit products or you cannot enjoy the purchased services due to technical reasons of Frameit products. You can file a refund appeal. After verification by Frameit, you can apply for a refund for you, but you need to provide corresponding information and cooperate with Frameit. You understand and clearly accept the above conditions. If you do not accept it, please choose the charged service carefully.
3.2 Term of service
3.2.1 The service period of this service is subject to the period you choose and pay the corresponding service fee. This service has monthly, quarterly and annual services. You can also log in to Frameit Personal Center or the corresponding page of this service to inquire. After the service period of the membership service expires, Frameit will stop providing you with membership services, and Frameit may remind you to renew the fee in time before the service period expires.
3.2.2 If you want to enjoy the service of continuous purchase and automatic deduction of membership services, you can apply to Frameit according to the operation guidelines, and decide whether to continue the application after carefully reading the "Frameit Member Automatic Renewal Service Agreement".
Opening of member services, account management and cancellation
4.1 After you pay the fee in accordance with the contract through the method designated by Frameit, you will open the service. After the service is opened, it is limited to your use on the Frameit platform, not unlike any other platform, and cannot be provided to any third party for use without the written consent of Frameit, including but not limited to gifts, sales, leases, borrows, shares, assignments, etc.
4.2 Management of member accounts
(1) You fully understand and agree that you are responsible for your actions under your login account, and all actions under this account are regarded as your own actions, including but not limited to any content you publish and the consequences arising therefrom, including risks arising from reliance on the correctness, completeness or usefulness of the content. You should make your own judgment on the content provided by this service and bear the risks arising from the use of related content.
(2) You should correctly use, properly keep and maintain your member account and password. In case of leakage, loss, theft, etc., such acts are not caused by Frameit's statutory fault, and the loss will be borne by you.
(3) Membership services are limited to the use of the application account; the recharge records and data between each account cannot be transferred, migrated, transferred, gifted, sold, leased, or shared, regardless of whether these accounts are owned by the same user or not, please pay attention to distinguish when logging in and/or participating in activities to avoid losses.
4.3 Use of accounts
You may not activate this service for yourself or others in any of the following ways:
(1) To open this service for yourself or others for the purpose of non-personal use such as profit, operation, etc.;
(2) Open this service for yourself or others through any program or software such as any robot software, spider software, crawler software, screen swiping software, etc.;
(3) Open this service for yourself or others through any improper means or in a manner that violates the principle of good faith;
(4) To activate the Service in a manner not specified by Frameit;
(5) Open this service by infringing the legitimate rights and interests of Frameit or others;
(6) Open this service for yourself or others through other methods that violate relevant laws, administrative regulations, national policies, etc.
You understand and agree that Frameit has the right to take corresponding measures (including but not limited to shutting down the service without notice, requiring you to compensate Frameit for all losses suffered as a result, and requesting judicial authorities to pursue legal responsibility) if you have the above behaviors.
4.4 Member account cancellation: Except for Frameit canceling the user's member account in accordance with the agreement or announcement and relevant laws and regulations, you can cancel the member account by applying online or contacting Frameit's customer service. Once you confirm that your account is cancelled, you will not be able to continue to use member services. And all content, information, data, and records involved in your use of related services through this account will be deleted or anonymized; unless otherwise provided by laws and regulations, you can no longer retrieve, access, obtain, continue to use and retrieve the aforementioned content, information, data, and records, and have no right to ask Frameit to retrieve them.
Member Code of Conduct
5.1 When using this service, you shall not use this service to engage in the following acts, including but not limited to:
(1) Publishing, transmitting, disseminating, and storing content that violates national laws, endangers national security and unity, social stability, public order and good customs, social morality, and insults, defamation, , and violence;
(2) Publishing, transmitting, disseminating, and storing content that infringes upon others' legitimate rights such as reputation rights, portrait rights, intellectual property rights, and trade secrets;
(3) Fictitious facts, concealing the truth to mislead or deceive others;
(4) Publishing, transmitting and disseminating advertising information and spam information;
(5) Engaging in other violations of laws and regulations (including but not limited to "Copyright Law of the People's Republic of China", "Regulations of the People's Republic of China on the Security Protection of Computer Information Systems", "Regulations on the Protection of Computer Software", "Regulations on the Administration of Internet Electronic Bulletin Services", "Regulations on the Protection of the Right to Disseminate Information Networks", "Cyber Security Law" and other laws and regulations related to computer and Internet regulations), policies, public order and good customs, social morality, etc.
5.2 The Service is for your personal use only and, except with the written permission of Frameit, you may not:
(1) Collect the usernames, emails and other related information of other users in this service by any means, and interfere and harass other users by sending Email Spam, Junk Email, Chain Mail, Spam Message, Instant Message, etc.;
(2) Publish information including advertisements, publicity, promotions, etc. through this service;
(3) License the service to others again;
(4) Other acts without the written permission of Frameit.
5.3 Change, Suspension or Termination of Services
5.3.1 The suspension or termination of this service includes the following situations:
(1) You voluntarily suspend or terminate, including but not limited to failure to renew the membership when it expires;
(2) Frameit voluntarily suspends or terminates the service due to your breach of contract;
(3) Frameit suspends or terminates the service due to the requirements of the state or relevant government regulatory authorities or in the event of force majeure;
(4) Other services that should be suspended or terminated according to laws and regulations.
5.3.2 You fully understand and agree that due to the particularity of Internet services, Frameit may modify, change, suspend or terminate some or all of the services provided to you in accordance with relevant laws and regulations, mutual agreements or other necessary times. At that time, Frameit will protect your legitimate rights and interests in accordance with the law. And you agree that the services provided in accordance with this service agreement can be changed, suspended or terminated without prior notice. For the change of service, if you continue to use it, you agree to the change. The circumstances described in this article are not deemed to be a breach of contract by Frameit, and Frameit does not assume any legal responsibility to you.
5.3.3 Frameit's failure to exercise or delay in exercising its rights under this Agreement in a timely manner does not constitute a waiver of those rights, and the sole or partial exercise of any of its rights under this Agreement does not preclude the exercise of any of its other rights.
Liability for breach of contract
6.1 Treatment of breach of contract
If Frameit discovers or receives reports from others that you have violated this agreement, Frameit has the right to make independent judgments and take technical measures to delete, block or disconnect the relevant information in accordance with the law. At the same time, Frameit has the right to take measures against you, including but not limited to suspending or terminating part or all of this service, suspending or terminating your use of Frameit members, and pursuing your legal responsibility, depending on the nature of your actions. Frameit does not need to refund you any fees, and the resulting losses to you shall be borne by you. If Frameit loses, you shall also compensate (including but not limited to direct economic losses, loss of goodwill and external compensation, settlement fees, attorneys' fees, court fees, etc.), and pay within the time limit required by Frameit.
6.2 Treatment of Third Party Damages
You shall be solely responsible for any damage to any third party caused by your violation of this agreement; if Frameit suffers losses as a result, you shall also compensate.
VII. Other
7.1 Entry into force of the Agreement
By using the Service, you are deemed to have read and agreed to be bound by this Agreement. Unless otherwise agreed in this Agreement, this Agreement shall take effect from the time you choose to accept or use the Service until the time of termination of the Service.
7.2 Applicable Law
The establishment, entry into force, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the mainland of the People's Republic of China (excluding conflict of laws).
7.3 Dispute Resolution
If any dispute or dispute occurs between you and [Frameit], it should first be resolved through friendly negotiation; if the negotiation fails, you agree to submit the dispute or dispute to the competent people's court for jurisdiction.
7.4 Effect of Terms
The terms of this agreement are partially invalid or unenforceable for any reason, without affecting the validity and execution of the remaining terms, and are binding on both parties.
